These Terms and Conditions (“Terms“) govern www.justgoout.co.uk (“the Website“) and Just Go Out App. Please read and confirm that you understand these terms. Please do not use the website and/or App if you do not agree with these terms.

 

  • Definitions
    • “Just Go Out“ is the trading name of Just Go Out Ltd, a company registered in England (Company Number: 12059561, VAT number: 284024611) whose principal office is at 862-864 Washwood Heath Road, C/O Sigma, Birmingham, West Midlands, B8 2NG.
    • “User“ means any person who uses or visits the Website and/or App.
    • “Service” means the Website and App.

 

  • Terms of Use
    • Just Go Out Ltd reserves the right to gather information relating to use of the Service. Please refer to our Privacy Policy for information on how your details are used. By visiting and using the Service you consent to the collection and use of this information by Just Go Out in accordance with our policies.
    • We reserve the right to withdraw, suspend or amend the Service that we provide on our site without notice for any reason including (but not limited to) repairs / maintenance / upgrades and will not be liable for any such suspension. If you create any user identification code, password or any other piece of information used as part of our security procedures, it must be treated as confidential and not disclosed to any third party.

 

  • Our Liability
    • The information provided on the Service is shown in good faith and intended as information only and does not constitute advice. It must not be relied upon to assist in deciding on a course of action.
    • While we make every effort to keep the Service up to date, we do not provide any guarantees, conditions or warranties as to its accuracy and availability. Your use of our Service and its contents shall be at your own risk. This does not affect our liability for death or personal injury resulting from our negligence, or our liability for fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.
    • Offers are provided by third parties and Just Go Out does not guarantee that the offers are valid. You are advised to check any discounts have been applied before committing to any purchase.

 

  • Jurisdiction and applicable law
    • Any dispute or claim that is made relating to our Service or terms shall be governed, construed and bound in accordance with the laws of England and Wales.
    • You are solely responsible for your interactions with businesses advertising on our service. You hereby release Just Go Out from any claims or liability related to any product, service, inaction or failure to comply with applicable law of a business.

 

  • Prohibited uses
    • You may use our Service only for lawful purposes. You may not use our Service:
      • in any way that breaches any applicable local, national or international law or regulation.
      • in any way or which has any effect that is unlawful or fraudulent.
      • for the purpose of harming or attempting to harm any person in any way.
      • to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.
      • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
      • to knowingly transmit any data, send or upload any material which is malicious or technologically harmful or which may adversely affect the operation of any computer software or hardware.
      • removing, modifying, altering or using any registered or unregistered marks/logos owned and doing anything which may be seen to take unfair advantage of the reputation and goodwill of Just Go Out.
    • You also agree not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of the terms and not to access without authority, interfere with, damage or disrupt:
      • any part of our site
      • any equipment or network on which our site is stored
      • any software used in the provision of our site
      • any equipment, network or software owned or used by any third party

 

  • Suspension and termination
    • We reserve the right to take any appropriate action against you if you breach any of these terms. This may include:
      • immediate, temporary or permanent withdrawal of your right to use our Service.
      • legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
      • further legal action against you.
      • disclosure of information to law enforcement authorities as we reasonably feel is necessary.

 

  • Obligations of the Advertiser (the Business)
    • The Advertiser will be responsible for the payment of fees and will be deemed to have full authority in all matters connected with the booking, approval or amendment of Advertising.
    • The Advertiser bears all the risk associated with providing the Advertising and confirms it has the rights to use whatever images it uses and will be responsible for both the provision of the content and its accuracy at all times.
    • The Advertiser will ensure that the Advertising conforms with all relevant laws and codes of advertising and will ensure that the Advertising will not contain any material that is defamatory, offensive, libellous, blasphemous or which infringes the right of third parties. This extends to the protected characteristics, as defined by the Equality Act 2010, to include: age, disability, gender reassignment, marriage and civil partnerships, pregnancy and maternity, race, religion or belief, sex, sexual orientation.
    • Just Go Out reserves the right to remove any Advertising to be deemed inappropriate for a family friendly environment or if instructed to do so by any regulatory body. Furthermore, Just Go Out may also edit text or images uploaded by the Advertiser as they deem appropriate.
    • The subscription can be terminated by the Advertiser by cancelling the monthly fee.
    • Invoices will be sent to the email address provided during sign-up when the account is created online.
    • You can make links and refer to Just Go Out provided that you do so in a way that is fair and legal, do not damage our reputation and do not take unfair advantage of the Service. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part without written consent.

 

  • General
    • If you feel that any material appearing on the Service is offensive, objectionable or potentially defamatory, or even just misleading or inaccurate, please contact Just Go Out by email on: info@justgoout.co.uk and provide full details of the nature of your complaint and the materials to which the complaint relates to.
    • You should check these terms and conditions regularly. We can update them at any time without notice. You agree to any changes if you continue to use the Service after the terms and conditions have been updated.
